Software usage Terms & Conditions

Important - please read these terms carefully before installing or using the software on your computer. By installing and using the software you acknowledge having read the terms set out below and you agree to be bound by the terms of this agreement. If you do not agree to the terms of this agreement you have no permission to install and use the Software.

1. Grant of Licence
You are granted a limited, non-exclusive, right to use ‘MyCreation.co.uk’ (hereinafter referred to as: the Software).

2. Ownership
You may not derive any property rights from the Software. You do however have the right to use the Software so long as you fully observe the terms of the licence agreement. Any other use of the Software by any individual, enterprise, organisation, government body or any other entity is strictly prohibited and is in violation of this licence agreement.

3. Copyright/Trademark
The software and documentation include material protected under UK law, stipulations in international agreements and is governed by the “United States Copyright Law and trade secret Law”. It is prohibited to remove or alter any company references from any copy of the software or documentation. NO licence, right or other interest in a trademark, trade name or service name is part of this grant of licence.

4. Limitations
It is not permitted to publish, show, reveal, lend, borrow, lease, distribute, modify and manufacture any derived products of the Software or any part of it. Nor is it permitted to apply any form of analysis to the Software by means of “reverse engineering”. It is not permitted to translate, adapt and attempt to recover the source code of the object code of the Software. You do not have permission to distribute the Software among networks and between instruments yourself; you do however have permission to use the Software to send other components. In addition you have permission to install the Software on several personal computers of the user so long as it is used on only one single computer at a time. It is not permitted to reproduce, store in an automated data file or send in any form whatsoever any single component of the documentation, with the exception of the stipulations in the grant of licence, without express written consent.

5. Secrecy
The user of this grant of licence acknowledges and respects the commercially and competitively sensitive information in the Software. The user must guarantee the secrecy of the Software, making efforts in this respect equal to the efforts to keep the secrecy of the user’s own sensitive information. The user will also in fairness communicate the stipulations and conditions of this licence agreement to its employees/students/members who come into contact with the Software, making at least reasonable efforts to have them adhere to the stipulations and conditions set out in this agreement. This also includes attempts at recovering the source code of the Software.

6. Disclaim of Warranty
The Software is supplied “as is”. To the maximum extent permitted by law, CLE Print Ltd disclaims all warranties, including suppositions either express or implied, without limitation, in respect of fitness for a particular purpose. CLE Print Ltd does not warrant that the functions in the Software will comply with any particular expectation or purpose or that the Software will run free of defects. Nor does CLE Print Ltd warrant that the Software will run uninterruptedly, any faults and defects will be remedied and that the Software will function on a specific platform. Some jurisdictions do not allow the disclaimer of particular implied suppositions. If this may be the case, the stipulations concerned do not apply to the user of this agreement.

7. Limitation of liability
In no circumstances will CLE Print Ltd be liable for any incidental or consequential damages for the user of the Software or any third party (including without limitation, indirect, special damage for loss of turnover, loss of profits, business interruption and the loss of business information), arising out of the use of or inability to use the Software. CLE Print Ltd entire liability under any provision of this licence agreement, the Software and documentation shall be limited to the supply of a new copy of the Software.

8. Photo albums, calendars, and other products
Neither CLE Print Ltd nor its business partners may be held liable for the contents of the photo albums, calendars, cards or any other products derived from the software. The user of the MyCreation.co.uk software is responsible for its contents and the work they supply to CLE Print Ltd. The user is obliged to take care that the use, the content and the distribution of files, photos and pictures are in accordance with the statutory provisions in the states and/or countries concerned.

9. Export limitations in the Software versions intended for the United States of America
This Licence agreement is subject to the laws, stipulations and other limitations regarding the export from the UK, which may be imposed by the authorities concerned, of the Software or information regarding the Software. You have no permission to export the Software, the documentation and information about the software in accordance with the statutory provisions and limitations.

10. Termination
This licence agreement expires by Termination only. The user may Terminate this agreement at any time by destroying all the copies of the Software and documentation or by returning it to CLE Print Ltd. CLE Print Ltd has the right to terminate this agreement for any reason, including but not limited by, if CLE Print Ltd establishes that the user is not adhering to one or more of the stipulations of this agreement. On request the user will destroy all copies and backup copies or send them to CLE Print Ltd upon termination and supply a written statement that these matters have in fact taken place. All stipulations regarding sensitive information, intellectual property rights and secrecy survive the termination of this Software licence agreement and will therefore remain in full force.
